I purchased multiple dedicated servers with the understanding that I could use standard services outlined in their Terms of Service. However, Cherry Servers is enforcing restrictions that directly contradict their written agreement

Their Terms of Service clearly state that Cherry Servers will "monitor outgoing SMTP traffic for security and spam prevention." I agreed to monitoring that's reasonable security. What I did not agree to was a blanket restriction limiting SMTP to only 2 emails per hour, because this restriction is not mentioned anywhere in the ToS.
When I contacted support, they confirmed that port 25 is heavily filtered and limited. They then tried to justify this by citing anti-spam clauses in the ToS. However, those clauses refer to preventing "unsolicited messages and spam" not blocking all SMTP traffic wholesale. There's an important difference between monitoring for abuse and artificially crippling a core service.

I have dedicated servers with dedicated IP addresses. Cherry Servers' argument about protecting "shared IP reputation" doesn't apply.
A 2 email/hour limit on my dedicated infrastructure serves no security purpose and makes the service completely unusable for legitimate business purposes.

What's most frustrating is that support acknowledged the issue but offered nothing constructive.
One representative even admitted "the ToS should be clearer" which confirms they know the current agreement is ambiguous.
Their solution? "pay for a third-party relay service" or accept a refund

This is a one-way relationship where Cherry Servers makes the rules, and when those rules conflict with the contract they offered me, their support team just shrugs.

If a service limitation isn't in your ToS, companies shouldn't enforce it. For a professional infrastructure provider, this handling is disappointing and reflects poor business practices.

Cherry was exceptional

Their team was quick to respond, servers were super steady, and when I was done, they quickly gave a refund for the remaining balance. Awesome work!

Great service overall, and the support is super helpful and great.

I love that they have dedicated server regions in the US, unlike other budget providers, which only offer them in Europe.

Worth the price for me, especially with the high bandwidth, private VLAN (allowing JUMBO frames, which was a huge requirement for our deployments), and local BGP.

It's more hands-on, but support is there when needed. They provide you with true bare metal from the group up when you need it, while abstracting away things you may not need, yet still allowing you to configure it when necessary.
